Speaking of the precedent-setting decision of the Allahabad High Court, double bench has upheld nullification of the merit list for the recruitment of 69 thousands primary teachers of Uttar Pradesh. This ruling means that the state government has to develop a new merit list within three months by following Basic Education Rules and Reservation Guidelines in its truest sense. This comes as the court has been observing meandering over issues to do with reservation irrelevance in the recruitment processes.

The controversy can be dated back to December 2018 when the Uttar Pradesh government released an advert to recruit 69,000 primary teachers. The number of candidates who had appeared in the examination by 2019 was more than 411,000 and the board results of 2020 report indicated that 147,000 candidates had cleared the examination amongst them 110,000 belonged to the reserved category. Even then however, voices were raised to the effect that at least about 19000 candidates belonging to reserved categories were being deprived of the benefits they were otherwise entitled under policies of reservation. These differences created legal concerns to the validity of the recruitment exercise.

The recent judgment of the Allahabad High Court canceling the merit list is a reminder of the need to follow the rules on reservation and be clear on the process of recruitment. Addressing these issues, the court has in effect instructed the Uttar Pradesh government for correcting these defects by preparing a new merit list of Gujarati Medium teachers in consonance with the norms of education and reservation as and when prescribed according to the rule of law. This development will therefore seek to achieve the following objectives: To address the concerns of affected candidates in order to regain confidence in the recruitment system and ensure that all future recruitment are fair, transparent, honest and equitable.
