On Thursday, the Supreme Court intervened in a case involving the potential demolition of a property. The court, led by Justice Hrishikesh Roy and supported by Justices Sudhanshu Dhulia and S.V.N. Bhatti, ruled that a person’s alleged involvement in a crime cannot be used as a reason to demolish their property.

The case began when Javed Ali, a resident of Kathlal gram panchayat in Kheda district, Gujarat, raised an urgent plea. Ali’s family home, where three generations have lived for over twenty years, was at risk of being demolished by local authorities. This threat emerged after an FIR was filed against a family member.

Ali’s lawyer, senior advocate Iqbal Syed, argued that the local municipal authorities were unjustly threatening to demolish the family’s home. He pointed out that the property had been legally constructed and that the actions of one family member should not impact the entire household.

Justice Roy and the other justices made it clear that such demolition threats are unacceptable in a country where the rule of law is paramount. They warned that allowing such actions could be seen as undermining the legal system and violating established rules. The justices emphasized that in a nation governed by law, one person’s alleged wrongdoing should not lead to collective punishment of their family or the destruction of their legally owned property.

The Supreme Court also referred to its recent decision to create a nationwide policy to protect private property from arbitrary government actions. Following these principles, the court ordered that the status quo on Ali’s property be maintained, preventing any demolition.

This ruling highlights the Supreme Court’s commitment to upholding legal standards and protecting individuals’ rights. By intervening, the court ensures that government actions are conducted fairly and according to the law, safeguarding property rights and maintaining justice.
