A recent judgment has been passed by the Supreme Court of India where it has ordered to take down all the content which related to the identity of victim including her name, photographs, and videos from social media sites. This directive comes in the wake of highly sensitize issue whereby a trainee doctor was reported to have been raped and killed at RG Kar Medical College and Hospital in Kolkata.

On Tuesday, DY Chandrachud, the Chief Justice of India, also heading a three-bench structure explained that the disclosure of the victim’s identity is incongruent with the apex court guidelines as known by the Nipun Saxena case. This precedent reaffirms the need to protect victims of sexual assault from public embarrassment and exposure. The Court stated it did about the presentation of the victim in the media especially with posting of pictures and identity in Facebook, Instagram, YouTube and x(former twitter).

Together with Justice J B Pardiwala and Manoj Misra, the bench answered the petition filed by the lawyer Kinnori Ghosh and other concerned individuals on the violations by such publications with the set legal standards of the protection for survivors. In their order, the Court also said that as much as the freedom of speech is cherished, it cannot be exercised in a manner that violates the rights of those people whose privacy and dignity have been violated in such dreadful circumstances.

The body of the deceased was found on 9 August, and the next day, the Kolkata Police arrested Sanjoy Roy, a civic volunteer. He is at present a CBI suspect and is likely to go for a polygraph test. This decision is considered a significant step in strengthening the protection in the judiciary for the victims in particular in delicate matters.
