President Murmu Delegates Extensive Authority to Delhi Lieutenant Governor Over Boards and Commissions, Intensifying Political Clash with AAP Government Ahead of Elections
More recently, President Droupadi Murmu gave broad powers to Delhi’s Lieutenant Governor, Vinai Kumar Saxena, to make and appoint members of any authority, board, commission or statutory body under the parliamentary laws for the capital. The MHA then issued a gazette notification stating that according to the Constitution of India and the Government of National Capital Territory of Delhi Act, 1991 section 45D the president’s order enable the Lieutenant Governor to exercise those powers till further order.

This new order is also likely to start fresh confrontation between the Delhi government and the Lieutenant Governor, two entities who are not seen eye to eye. The President’s action comes after she assented to the Government of National Capital Territory of Delhi (Amendment) Bill 2023 that had earlier transferred the responsibility of officer transfers and postings to the National Capital Civil Services Authority NCCSA. This force, I believe, headed by the Chief Minister Arvind Kejriwal and consists of two seasoned Delhi bureaucrats got empowered to take decisions though the final power lies with the Lieutenant Governor.

As usual, the move received opposition from various corners as the following reasons would show. Delhi’s elected government has been accused of being assailed by the Centre by Kejriwal. Fueling the fire further, Delhi Minister Saurabh Bharadwaj accused the Lieutenant Governor of plotting to use the state’s cash to promote himself and cheer himself on social media, dubbed by Bharadwaj as a conspiracy to influence voter’s opinion before the forthcoming assembly elections in Delhi.
