Recently, Tis Hazari Court in Delhi released on bail Manoj Kathuria who was driving the SUV resulted into an unfortunate incident that claimed lives of three individuals intending to write IAS examination in Old Rajender Nagar. This incident took place when Kathuria was driving his car in the rainy season and causing heavy flooding that affected Rau’s IAS Study Circle and drowned the students.

Kathuria’s defense counsel was Rakesh Malhotra who argued that the driver was not involved in the incident in any criminal way. The counsel condemned Delhi Police involvement as speculative, and there was no factual evidence presented by the police for their interference.
The court also shared this view, harshly criticizing the Delhi Police for working with ‘over-enthusiasm’. ACJ Manmohan put doubts over the police’s decision to arrest Kathuria asking the driver to be responsible for water, entering basement?

The court was not satisfied with this, and the bench pointed to broader structural concerns, such as the absence of financing for infrastructure upgrades and blaming these problems on the Delhi government’s “freebie culture.” The police, however, dismissed the more severe charge of culpable homicide not amounting to murder due to lack of sufficient evidence.

The video also captured Kathuria driving his SUV on the street few minutes before floodwater surging into the coaching center. This footage showed the car moving through the area and as a result of it the water flow which led to the breaking of the center’s gate. But the Delhi Police had turned against Kathuria earlier, branding him as ‘masti,’ and the court allowed bail acknowledging that the charge of culpable homicide was not proven.
