Arvind Kejriwal, the chief minister of Delhi, has filed a lawsuit in the Supreme Court contesting the Central Bureau of Investigation’s (CBI) arrest of him in relation to the Delhi excise policy case.Kejriwal’s senior attorney, Abhishek Manu Singhvi, brought up the urgent listing of the petition before a bench chaired by Chief Justice of India DY Chandrachud. After reviewing the email request, the CJI stated he would set a date.

Since his arrest by the ED on March 21, Kejriwal has been detained. In May, the top court gave him a 21-day interim bail so that he may campaign in the Lok Sabha election. In the ED case, the top court acknowledged that Kejriwal had been detained for more than ninety days when it granted him interim bail on July 12. But Kejriwal is still in judicial prison because the CBI arrested him on June 26 in connection with the same case.

Kejriwal appealed the Delhi High Court’s August 5 ruling to the Supreme Court. His challenge against the CBI arrest was rejected by the high court, and he was free to get bail from the trial court. AAP leader Manish Sisodia was granted bail by the supreme court last week in relation to cases filed by the CBI and Enforcement Directorate regarding the Delhi excise policy. Sisodia suffered through a 17-month incarceration before being released.The Supreme Court granted Sisodia bail last Friday, stating that it would be futile to keep him behind bars if there is no chance that his trial will ever end and that, above all, his fundamental right to liberty and a prompt trial under Article 21 of the Constitution would be violated by his prolonged incarceration.
