BMW Crash Case Update: Gaganpreet Kaur Sent to Tihar Jail After Court Orders Two-Day Judicial Custody Amid FIR Dispute

The high-profile BMW crash case in Delhi has taken another turn, as accused Gaganpreet Kaur was remanded to two days’ judicial custody and brought to Tihar Jail on Tuesday. The tragic accident, which claimed the life of Finance Ministry official Navjot Singh and left his wife with severe injuries, has now become a major legal battle over charges, delay in FIR registration, and the question of culpability.

Gaganpreet was produced before Duty Judicial Magistrate First Class Akanksha Singh at the judge’s residence after being taken into custody by Delhi Police. The Patiala House Court also issued notice on her bail plea, which will be heard on September 17, when she is scheduled to be presented again. Senior advocate Vikas Pahwa appeared on her behalf, while advocate Ishan Dewan represented the victims.

The prosecution sought judicial custody, which the court granted for two days. According to advocate Dewan, the primary concern at this stage is ensuring justice for the victim’s family and preventing such incidents from repeating. He emphasized that all facts and evidence would be presented before the court in the upcoming proceedings.

The accident occurred on Sunday afternoon near Delhi Cantonment when the BMW allegedly driven by Kaur collided with a motorcycle carrying Navjot Singh and his wife. The impact caused the two-wheeler to crash into a DTC bus. Singh, who served as Deputy Secretary in the Ministry of Finance and lived in Hari Nagar, sustained fatal injuries and was declared dead upon arrival at the hospital. His wife suffered multiple fractures and head injuries and is still under medical care.

Meanwhile, the defence has strongly challenged the allegations against Kaur. Senior advocate Vikas Pahwa raised objections to the FIR, arguing that there was an unexplained delay of nearly ten hours in its registration. He pointed out inconsistencies, saying the FIR was filed at 11:30 pm, while the crash happened at 1:30 pm, and even contradicted details provided in official press briefings.

Pahwa further argued that the case, at best, falls under rash and negligent driving, which is a bailable offence. He claimed that attempts were being made to escalate the case by including non-bailable sections like Section 304 (culpable homicide not amounting to murder). According to him, such an approach was unjustified given the circumstances.

The defence counsel also highlighted that the accident took place at a sharp turn, leading to the front portion of the BMW colliding and causing the fatal chain reaction. He pointed out that Kaur herself, along with her husband and children, were inside the car and also suffered injuries due to the impact when airbags deployed. He insisted that this incident could not be seen purely as reckless or negligent driving.

Another major contention from the defence was the absence of CCTV footage in court. Pahwa also addressed the allegations that the victims were taken to a hospital located far away instead of the nearest medical facility. He clarified that Kaur had spoken to doctors in advance to arrange emergency treatment and that the victims reached the hospital in about 46 minutes. Despite the efforts, Navjot Singh was declared brought dead at 2:16 am.

The defence also maintained that the FIR reflected only the version of the investigating officer, not the actual sequence of events. Pahwa confirmed that Kaur’s bail application had been moved and is scheduled to be heard on September 17, the same day she will be produced in court again after completing her two-day judicial custody.

As the legal proceedings continue, the case remains under close public and media scrutiny. The tragic loss of a senior government official and the legal complexities surrounding the FIR and charges have made this one of Delhi’s most closely followed accident cases in recent times. For now, all eyes are on the next court hearing, which will determine whether Gaganpreet Kaur is granted bail or continues to remain in custody as the investigation progresses.
