The Supreme Court expressed deep concern about the indefinite suspension of a Member of Parliament, particularly from the Opposition, emphasizing the importance of diverse voices in Parliament. The court was hearing a case brought by Raghav Chadha, an AAP MP, who was suspended from the Rajya Sabha over a privilege breach. The court noted that ousting an Opposition MP not only deprives their constituents of representation but also removes a distinct voice in Parliament.

Parliamentary Voice: Concerns Raised
Raghav Chadha’s suspension lasted for 75 days, and the court expressed the need for Parliament to have voices from different spectrums. It also raised questions about the indefinite suspension of a parliamentarian pending a final decision by the privileges committee, emphasizing the importance of proportionality in such matters.

The court will further examine the issue and has requested written submissions from both sides. Raghav Chadha’s argument centres on the idea that suspension cannot extend beyond the session and that the Chairman’s additional powers cannot be used to prolong the suspension.
