Hathras Gangrape Case: UP Court convicts Sandeep while acquitting the other three accused, is justice denied?
An Uttar Pradesh Court has convicted only one accused in Hathras Gangrape Case and acquitted three others of all charges in the 2020 gangrape and murder of a 19-year-old Dalit woman.
The four accused in a gangrape of a Dalit woman – Sandeep (20), Ravi (35), Luv Kush (23), and Ramu (26) – faced the trial but the court found only Sandeep guilty of committing the offence of Culpable Homicide Not Amounting to Murder (Section 304 IPC) and for offences under the SC/ST Act.
The victim’s family advocate, Seema Kushwaha, remarked, “We will try to appeal before the High Court against this judgment.”
After details of the verdict came out, convicted Sandeep’s uncle, Rajender Singh, expressed angst, “I welcome this judgment but why was Sandeep the only one who was convicted? This whole trial was marred by politicians and media persons.”
The verdict by the Lower court consequently dismisses the ‘gangrape’ of the minor Dalit woman. So the question arises, is justice denied?
What is Hathras Case?
On the fateful day of 14 September 2020, a 19-year-old woman was allegedly gang-raped and attacked by four upper-caste men, who left her bleeding in a field in the Hathras district of Uttar Pradesh. She was found by her family and taken to a hospital in Aligarh and then to Delhi’s Safdarjung Hospital. After 11 days she breathed her last in the hospital.

The body was taken in an ambulance late in the evening to her village and reportedly cremated at 3.30 am without the permission and cooperation of her family members by the UP police and other officials.
The chargesheet filed based on the analysis of call detail records stated that “the relationship/affair between the victim and accused Sandeep was in good form till March 2020”.
According to the CBI, the Dalit woman was raped by four men after she snubbed one of them, Sandeep, and this “change in their relationship” had “aggravated his feelings” and “frustrated him”.
The CBI specified that the relationship became extremely sour when their family members found out about them. It may have led to the horrendous incident.
